General Terms and Conditions (GTC)
- Introductory Provisions
These General Terms and Conditions (hereinafter referred to as “GTC”) regulate the mutual rights and obligations between Climbing Architects s.r.o, with registered office at Liberecká 480/104, 466 01 Jablonec nad Nisou, ID No.: 09526145, registered in the Commercial Register maintained by the Regional Court in Ústí nad Labem, file No. C 45909 (hereinafter referred to as the “Seller”), and the Buyer when purchasing goods through the Seller's online store located at the web address https://aboutholds. com (hereinafter referred to as the “e-shop”).
The Buyer shall be understood as a natural person who is not an entrepreneur (consumer) or a natural person who is an entrepreneur or a legal entity (hereinafter referred to as the “Buyer”). For the purposes of these GTC, a distinction shall be made between a consumer and an entrepreneur where legally relevant.
These GTC are an integral part of the purchase contract concluded between the Seller and the Buyer. Any divergent provisions in the purchase contract shall prevail over the provisions of these GTC.
The Seller may change or supplement the wording of the GTC. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the GTC.
- Ordering goods and concluding a purchase contract
All presentation of goods placed in the e-shop is informative and does not constitute an offer within the meaning of § 1732 section 2 of the Civil Code of the Czech Republic.
The buyer places an order for goods through the e-shop. Before sending the order, the buyer has the possibility to check and change all the data he has entered in the order.
The order sent by the Buyer constitutes a proposal for the conclusion of a purchase contract.
The Seller shall confirm its receipt to the Buyer by e-mail to the e-mail address specified by the Buyer in the order without undue delay after receipt of the order. This confirmation does not constitute acceptance of the proposal for the conclusion of the purchase contract.
The purchase contract is concluded at the moment of delivery of the acceptance of the order (acceptance of the proposal) by the Seller to the Buyer by e-mail.
The Seller is entitled, depending on the nature of the order (quantity of goods, amount of the purchase price, estimated shipping costs), to ask the Buyer for additional confirmation of the order (for example, by phone or in writing).
The Seller reserves the right not to accept the order, especially in case of an obvious error in the price of the goods, unavailability of the goods or repeated violations of these GTC by the Buyer.
- The consumer has the right to withdraw from the purchase contract without giving any reason within 14 days from the date of receipt of the goods. In the event that the subject of the purchase contract is several types of goods or the delivery of several parts, this period shall run from the date of receipt of the last delivery of goods.
To withdraw from the purchase contract, the consumer may use the sample withdrawal form, which is an annex to these GTC and is available on the e-shop https://aboutholds.com. The withdrawal from the purchase contract must be sent to the seller within the above mentioned period.
In case of withdrawal from the purchase contract, the purchase contract is cancelled from the beginning. The goods must be returned to the Seller without undue delay, no later than 14 days from the date of withdrawal.
The Seller shall return to the Consumer without undue delay, no later than 14 days from the date of delivery of the notice of withdrawal from the Purchase Contract, all monies received from the Consumer under the Purchase Contract, including the cost of delivery of the goods (except for additional costs incurred as a result of the Consumer's chosen method of delivery, which is different from the cheapest standard method of delivery offered by the Seller).
The consumer shall be liable to the seller for any diminution in the value of the goods resulting from handling the goods other than that necessary to familiarise himself with the nature, characteristics and functionality of the goods.
For entrepreneurs: the right of withdrawal for entrepreneurs is governed by the relevant provisions of the Civil Code of the Czech Republic. The Seller reserves the right to assess the possibility of withdrawal by the entrepreneur on an individual basis.
- Final Provisions
These GTC and all legal relations arising from them are governed by the law of the Czech Republic, excluding conflict of laws rules.
Any disputes between the Seller and the Buyer, who is a consumer, may be settled out of court through the Czech Trade Inspection Authority (Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2, internet address: https://adr.coi.cz).
The Seller is entitled to change or amend these GTC at any time. Changes and amendments to the GTC shall take effect on the date of their publication on the e-shop https://aboutholds.com.
The invalidity or ineffectiveness of any provision of these GTC shall not affect the validity and effectiveness of other provisions.
